What’s the best-kept secret in the United States Constitution? If you answered, “the Ninth Amendment,” congratulations! Move to the head of the class.
Here it is, that pesky little rarely used Amendment: “The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.”
That’s it. Just 21 words. But when federal, state, and local governments increasingly use crises—real or imaginary—as reasons to encroach on Americans’ rights to life, liberty, and property, it just could turn into one of the most important parts of the Constitution. And when they use appeals to “systemic racism,” “Critical Race Theory,” “equity,” and “social justice” to force all of us not just to treat everyone fairly but actually to celebrate such things as abortion, homosexuality, and transgenderism, striking deep wounds in both liberty and justice, those 21 words could enable states and citizens to strike back—and win!
